Arise News247 reports that the controversial Justice Okon Abang of the Federal High Court, has on Wednesday 25th October, 2017 in Abuja, again fixed 31st October, 2017 for former President Goodluck Jonathan to appear as a defendant witness, as the former National Publicity Secretary of People’s Democratic Party (PDP), Olisa Metuh, sought the appearance of the former president to open his defence in the N400 million fraud suit brought against him by the EFCC.
Olisa Metuh had filed an application to compel both ex-president Jonathan and Col Sambo Dasuki to appear before the court to testify in the N400 million fraud charge brought against him (Metuh). And the Court of Appeal in Abuja granted the application on October 3, 2017; Arise News247 obtained.
Thus, justice Abang in his bench ruling on October 24, 2017 issued a subpoena mandating both the former President Jonathan and the former NSA, Dasuki to appear before the court on October 25, 2017 as defendant witnesses to Metuh.
However, the ex-president failed to appear in court October 25 to honour the subpoena of the trial court to testify.
Justice Okon Abang therefore made a bench ruling that Jonathan must appear before the court on October 31 being the next date of adjournment. Adding that “it is clear that His Excellency, the former President Goodluck Jonathan is not in court in compliance with the October 3 order of the Court of Appeal, Abuja. We have however, seen from the record that his absence could not have been his fault as the bailiff is unable to serve him with enrollment order to that effect.
“In the light of that, the matter is adjourned until Oct.31 to enable this service to be made. However, if serving personally fails again, he would be served by substituted means.”
He thus threatened that “after due diligence, the court would ensure that the law takes it course if the former president refuses to honour the subpoena.’’ Adding also that “a deliberate violation of subpoena carried jail term of not less than two months and a fine of N10,000”
In a similar development, he gave an order compelling the Director- General of the Department of State Service (DSS) to ensure retired Col Sambo Dasuki appear in the court on October 31; explaining that the court was aware that Dasuki was in custody of the Federal Government. Hence, he couldn’t have appeared except the DSS brought him.
